JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Rani Talab P.S. Case No. 145 of 2018 registered for the offences punishable under Sections 341, 323, 307 and 354B of the Indian Penal Code.

As per FIR petitioner tried to outrage the modesty of wife of informant and when her son came petitioner assaulted him.

Submission of learned counsel for the petitioner is that there is no specific allegation of assault against him and a case has been lodged by the petitioner earlier to lodging of the present case in which persons from petitioner's side have also received injuries and thereafter the present case has been lodged making ornamental allegation of outraging modesty and both the parties are co-villagers.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri P. K. Malviya, Judicial Magistrate, 1st Class, Danapur, Patna, in connection with Rani Talab P.S. Case No. 145 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
