The petitioner is apprehending his arrest in connection with Complaint Case No. 159 of 2017 for the offence registered under Sections 498(A)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is willing and ready to keep his wife with full honour and dignity and that there shall be no recurrence of any act of torture so as to occasion her discomfort in her matrimonial home. It is further submitted that he will go and collect his wife as soon as possible.

No.68427 of 2019(2) dt.27-11-2019 2/2 Considering the aforesaid facts and circumstances of the case and the bona fide stands taken by the petitioner, let the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bikramganj at Rohtas in connection with Complaint Case No. 159 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

It is made clear that if at all there shall be recurrence of any act of mental torture on the opposite party no. 2, it shall be open to the opposite party no. 2 to move this Court for appropriate legal recourse including cancellation of bail. (Anjana Mishra, J) Jagdish/- U T
