JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-05-2019 Heard learned counsel for the petitioner and the State as well as Mr. Vinod Kumar Sinha, learned counsel appearing on behalf of respondent nos. 3 and 5.

2. The petitioner is aggrieved by the order dated 14.08.2017 whereby the District Magistrate, Sheikhpura has cancelled the agreement of the petitioner for running Woman Short State Home.

3. The grievance of the petitioner is the order dated 14.08.2017 was passed without hearing him.

4. In matters like the present, interference is minimal,

Patna High Court CWJC No.14986 of 2017(3) dt.17-05-2019 2/2 particularly, after the incident of Muzaffarpur Care Home. In view of the above, the Court is not inclined to grant indulgence to this petitioner. However, refusal to grant indulgence in the instant case does not disentitle the petitioner to claim payment of the dues for running Woman Short State Home in the district of Sheikhpura.

5. In case, the petitioner files application before the District Magistrate, Sheikhpura for payment of dues, who shall cause an enquiry and if any of the amount is payable to the petitioner, the District Magistrate shall pay the same within a period of four months from the date of filing of such application along with a copy of this order.

6. With the aforesaid, this application stands disposed of.
