2. The petitioner apprehends his arrest in connection with Bhore P.S. Case No. 333 of 2025 registered for the offences under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.
3. As per the prosecution story, on 10.07.2025, SubInspector Pankaj Kumar, along with police and excise personnel, conducted patrolling and raids against illicit liquor traders in Gopalganj. Around 3:10 PM, based on secret information, they reached a bush near Government Primary School, Parsoni, where Sikandar, son of Mangroo, was allegedly storing illicit liquor. Sikandar fled on seeing the police. A search of the area recovered 21 bottles of liquor (Kingfisher, Royal
Patna High Court CR. MISC. No.69035 of 2025(2) dt.08-10-2025 2/3 Stag, and Bunty Babli, totaling 5.925 liters). As no public witnesses were available, two accompanying personnel acted as witnesses. The seized liquor was documented, sealed, and stored at the police station. A formal case was registered based on this report.

Learned counsel for the petitioner submits that altogether 5.925 liters of illicit liquor is said to have been recovered from a bush which is an open place and accessible to general public and further, the petitioner is in no way connected with the seized articles. The petitioner further submits that he has three criminal antecedent, out of which petitioner is on bail in two of the said cases and in the third case being Bhore P.S. Case No.331 of 2025 under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, is listed before a Co-ordinate Bench of this Court for further consideration.
5. Learned APP for the State opposes the prayer for anticipatory bail application.
6. Regard being had to the submission made by the parties, taking into consideration the fact that illicit liquor has not been recovered from the conscious possession and / or premises belonging to the petitioner, accordingly, this Court is inclined to grant anticipatory bail to the petitioner.

7. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Addl. Sessions Judge-XIII-cum-Special Judge Excise Court, I, Gopalganj, in connection with Bhore P.S. Case No. 333 of 2025 subject to the condition as laid down under Section 482(2) of the B.N.S.S., 2023.
