2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
3. The petitioner is apprehending his arrest in a case in connection with Supaul Nadi P.S. Case No. 16 of 2023 dated 15.02.2023 registered for the offence/s punishable u/ss 143, 147, 148, 149, 341, 323, 307, 504, 506 of the Indian Penal Code and 27 of the Arms Act.
4. As per the prosecution case, police got information that an altercation took place between a Baarat party and the FIR named petitioner and the co-accused persons due to that
Patna High Court CR. MISC. No.72466 of 2023(2) dt.10-11-2023 2/3 some persons got injured. When the police party reached on the spot they recovered two empty cartridges. It is further alleged by local public that the co-accused Pradeep yadav is a veteran criminal and supplier of liquor and the co-accused Anil Kumar and Dilip Yadav also involved in liquor business.
5. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has surfaced on the disclosure of the local public. There is general and omnibus allegation against the petitioner. The petitioner is also accused in one more criminal case as stated at para 3 of the bail petition.
6. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.
7. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Supaul in connection with Supaul Nadi P.S. Case No. 16 of 2023, subject to conditions as laid down under section 438(2) of the Code of
Patna High Court CR. MISC. No.72466 of 2023(2) dt.10-11-2023 3/3 Criminal Procedure.
8. The application stands allowed.
