JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2018 The petitioner seeks regular bail in connection with Sonepur P.S. Case No. 464 of 2017, registered for offences punishable under Sections 393 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation is that when the informant and others came to the bank to deposit an amount of Rs. 9,28,094/-, two miscreants came into the Bank and tried to snatch away the said money on the point of pistol, which was resisted by the informant, then one of the accused made firing, which hit in the back of the informant. However, informant any how managed to flee away with the money.
It has been submitted on behalf of the petitioner that petitioner is not named in the F.I.R., his name surfaced in this
Patna High Court Cr.Misc. No.65400 of 2018(2) dt.19-11-2018 2/2 case on the basis of confession of co-accused and on his own confession and except that there is nothing against the petitioner. No test identification parade has been held till date and petitioner has been in judicial custody since 15.12.2017. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Chapra, Saran, in connection with Sonepur P.S. Case No. 464 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
