The sole petitioner apprehending his arrest in connection with Baniyapur P.S. Case No. 306 of 2018 registered for the offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2016 , has prayed for grant of bail in the event of his arrest or surrender.
Learned counsel for the petitioner has drawn my attention to the statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. He has also drawn my attention to the seizure list at page no. 13 to show that nothing was recovered from the house of the petitioner or from his courtyard, rather in the case recovery was shown near the main gate of the house of the petitioner. It has been reiterated
Patna High Court Cr.Misc. No.62763 of 2018(2) dt.08-10-2018 2/2 that petitioner was not at all aware about such liquor and total 15 liters of country made liquor was shown to be recovered. In view of the nature of accusation and clean antecedent of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner - Lal Babu Rai @ Lal Babu Manjhi be enlarged on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge , Saran / concerned court in connection with Baniyapur P.S. Case No. 306 of 2018 subject to the conditions as contemplated under Section 438(2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J) praful/- U T
