Petitioner seeks bail in connection with Madhuban P. S. Case No. 205 of 2013 registered for the offence punishable under section 395 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report and he has been falsely implicated in this case on confessional statement of the co-accused. Nothing has been recovered from the conscious possession of this petitioner. Except the above confessional statement, there is nothing against this petitioner. Similarly situated co-accused has been granted bail by this Court vide order dated 26.05.2015 passed in Cr. Misc. No. 12241 of 2015 (Annexure-2). Petitioner is in

Patna High Court Cr.Misc. No.61337 of 2018(2) dt.08-10-2018 2/2 custody since 05.07.2018.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Madhuban P.S. Case No. 205 of 2013.
