JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-03-2023 Heard learned counsel for the petitioner and the State. Petitioner seeks pre arrest bail in a case registered for the offence punishable under Section 363, 366(A) of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons kidnapped the minor daughter of informant.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The victim in her statement u/s 164 of the Cr. P. C. has stated that she was in love affairs with co-accused, Pritam Mandal, and she left her house and went with him out of her own free will. Petitioner has been made accused in this case only because she happens to be mother of co-accused, Pritam

Patna High Court CR. MISC. No.69644 of 2022(2) dt.21-03-2023 2/2 Mandal. Petitioner has got no criminal antecedent. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the statement of victim recorded u/s 164 of the Cr. P. C. , let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj PS case No. 347/2022, subject to condition as laid down u/s 438(2) of the Cr.
