In this case, the petitioner is seeking anticipatory bail in connection with Masharak P.S. Case No.342 of 2017 registered for offence punishable under sections 413, 414 of the Indian Penal Code.

On secret information, the police force reached to Masharak Road near the temple and saw that one person lifting his motor cycle started fleeing away from there, he was arrested and he has disclosed the name of this petitioner, Bittu Kumar. On enquiry about the motor cycle, he has replied that he has committed theft of motor cycle from Railway Station and he has taken the name of members of the gang, who are involved in

Patna High Court CR. MISC. No.67601 of 2019(2) dt.05-03-2020 2/2 such type of committing offence and from each member, the theft motor cycle has been recovered.

Looking to the fact that the large number of cases against the petitioner, this Court is not inclined to grant bail to him and accordingly his prayer for bail is rejected. However, if he surrenders before the court below within three weeks from today and prays for regular bail, the court below will pass the order in accordance with law.
