JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 307, 504, 506 and 302 of the Indian Penal Code.

As per the prosecution case, this petitioner and coaccused Pankaj Das assaulted on the head of the informant with bricks.

It is submitted that as per F.I.R., petitioner is not alleged to have assaulted the deceased, rather it was co-accused Mahendra Das who is alleged to have given Khanti blow to the mother of the informant who subsequently died during treatment. There is no injury report of the informant on record. The petitioner claims clean antecedent.

Learned counsel for the State opposes the bail petition

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Gaya in connection with Main(Men) P.S. Case No. 18 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
