JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 376 of Indian Penal Code and Section IV, V and VI of POCSO Act.

There is specific allegation of rape against the petitioner and the victim has supported the accusation in her statement recorded under Section 164 of the Code of Criminal Procedure.

Learned counsel of the appellant submits that the medical report of victim does not corroborate the claim of victim and, moreover, there is lis between the petitioner and informant.
