JUSTICE SANJAY PRIYA ORAL ORDER 25-10-2018 Heard learned counsel for the petitioner, the learned counsel for the State and learned counsel for the informant. The petitioner seeks bail in a case instituted for the offence under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged by the informant that there is specific allegation of committing murder of his son against Golu Sonar Golu Sonar has named this petitioner in his confessional statement.
It has been submitted on behalf of the petitioner that from the fardbeyan, it appears that the informant has not named the petitioner in the alleged offence. The Sessions Judge has mentioned in the impugned order that the name of the petitioner has come in the confessional statement of co-accused Golu Sonar.
Patna High Court Cr.Misc. No.64137 of 2018 (2) dt.25-10-2018 2/2 The petitioner is in custody since 07.06.2018. Co-accused Sonu Kumar @ Babu Saheb @ Nishant Raj and Golu Kumar have already been granted bail by another co-ordinate Bench of this Court vide Cr. Misc. No.56331 of 2018 dated 20.09.2018 and Cr. Misc. No.60413 of 2018 dated 06.10.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIII, Patna in Beur P.S. Case No.154 of 2018. Both the bailers will be close relative of the petitioner. (Sanjay Priya, J) Amit/- U T
