Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 363, 365 and 34 of the Indian Penal Code.

Prosecution's case in short is that these petitioners and their son kidnapped daughter of the informant. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. As a matter of fact, petitioners happen to be mother and father of co-accused Md. Firoz Alam who is alleged to have kidnapped informant's daughter. It is further

Patna High Court CR. MISC. No.68774 of 2022(2) dt.20-03-2023 2/2 submitted that son of the petitioners and the victim have solemnized marriage and are residing together in Maharastra. Petitioners are aged persons and have got no criminal antecedent.

Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate Gaya in Kotwali Police Station Case No. 541 of 2021, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
