2. Petitioner seeks her regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. There is recovery of 98 litres illicit liquor from the bags of petitioner and other co-accused, who succeeded to flee away from the spot seeing the police.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case merely on suspicion. Nothing has been recovered from conscious possession of the petitioner rather the alleged recovery has been made from the place situated near Pahleja Railway Steation, which is open place accessible to all. Petitioner has no concern with the seized liquor. There is no

Patna High Court CR. MISC. No.69217 of 2025(2) dt.24-09-2025 2/2 independent witness of the seizure list. Petitioner has one criminal antecedent of similar nature in which she is on bail. Petitioner is in jail since 17.08.2025 and she undertakes to cooperate in the trial.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case, the submissions of the parties and period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Rohtas in connection with Sasaram Excise P.S. Case No.287 of 2025.
