The petitioners being parents, brother and married sister of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 498A and 379/34 of the IPC and Sections 3 and 4 of Dowry Prohibition Act.
The prosecution case is that the marriage of the informant with Rameshray Pal was performed on 26.4.2012 but subsequent to the marriage further dowry demand of motorcycle and buffalo was made and ultimately she was driven out of the matrimonial house.
It is submitted by learned counsel for the petitioners that
Patna High Court Cr.Misc. No.65133 of 2018(2) dt.12-12-2018 2/2 the thrust of accusation is against the husband of the informant. The accusation is omnibus and general against the petitioners. Learned counsel for the informant submits that the entire in-laws family members inflicted torture upon the informant and presently the informant is under advanced stage of pregnancy and there is none to maintain her.
Considering the omnibus and general accusation against the entire in-laws family members, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Kaimur at Bhabua in connection with Mahila (Bhabua ) P.S. Case No.47 of 2018 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
The bail bond of the petitioner no. 1 will be accepted on deposit of Rupees Ten Thousand before the learned court below, which will be released in favour of the informant. (Dinesh Kumar Singh, J) anil/- U
