JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 The petitioners seek regular bail in connection with Khagaria (Muffasil) P.S. Case No. 207 of 2018, registered for offences punishable under Sections 147, 148, 149, 448, 341, 323, 307, 302, 379/120B of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioners is that on the order of co-accused Atmaram Yadav, other co-accused Ashok Yadav fired gun shot, which hit the Bhavo of the informant. Submission of learned counsel for the petitioners is that no specific allegation has been attributed against the petitioners, rather than the allegation of firing is against other co-accused person Ashok Yadav. Further submission is that

No.67081 of 2018(2) dt.26-11-2018 2/2 other co-accused person having similar allegation has already been granted regular bail by this Court vide order dated 25.10.2018 passed in Cr. Misc. No. 63608 of 2018 and by a Coordinate Bench of this Court vide order dated 19.07.2018 passed in Cr. Misc. No. 42809 of 2018.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Muffasil) P.S. Case No. 207 of 2018, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
