2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 302, 120 B and 34 of the Indian Penal Code and 27 of Arms Act.
3 . As per the prosecution case , informant namely , Sunil Kumar alleged that on 30.12.2015, six persons sitting on two motorcycles came to the tea shop where deceased ( brother of informant ) was present and one of the accused persons fired upon him due to which he succumbed to the injuries and thereafter, deceased was taken to the hospital where he was declared dead.

4. It is contended on behalf of petitioner that petitioner is not named in the F.I.R. The name of petitioner transpired only on the basis of suspicion that three months back before the occurrence , he along with others had threatened the deceased to kill. Informant is not an eye witness to the alleged occurrence . It is further contended that during course of investigation , wife of the deceased stated that the alleged occurrence took place in her presence and it was co-accused Randhir Yadav who fired upon deceased. It is further contended that petitioner has not committed any offence as alleged and except suspicion , there is no other material on record to substantiate the allegation against this petitioner. Similarly situated co-accused person has already been granted bail by Coordinate Bench of this Hon'ble Court vide order dated 12.05.2016 in Cr. Misc. No. 18693 of 2016.
5. Learned counsel for the State opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the
