JUSTICE JITENDRA KUMAR ORAL ORDER 04-11-2025 The writ petitioner is aggrieved by non-execution of the permanent non-bailable warrant of arrest against the accused persons namely, Dhurpat Thakur and Shanti Devi in Complaint Case No. 3513(C) of 2010 pending in the court of Mrs. Gayatri Kumari, learned A.C.J.M. Patna .

2. Heard learned counsel for the petitioner and learned APP for the State.

3. In my considered view, the present writ petition is misconceived. The petitioner should have approached the concerned learned ACJM Patna, for execution of the warrant

Patna High Court CR. WJC No.508 of 2018(3) dt.04-11-2025 2/2 issued by her because it is a duty of Court concerned to execute the process which has been issued by it.

4. Hence, the present petition is dismissed as not maintainable with liberty to the petitioner to move an application before the Court concerned which has issued the warrant against aforesaid accused persons for execution of the warrant in question.
