The petitioner is languishing in custody since 4.8.2019 in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The prosecution case is that 40 litres of country made liquor was recovered from the adjacent heap of sand. It is alleged that the petitioner along with Jitan alias Ajit used to do liquor business.

It is submitted by learned counsel for the petitioner that no recovery has been made from the conscious physical possession of the petitioner.

Learned APP submits that the petitioner was found involved in liquor trafficking.
