The petitioners seek pre-arrest bail in connection with Gopalpur P.S. Case No. 91 of 2017 registered under Sections 363, 366A and 34 of the Indian Penal Code.

The accusation is of kidnapping of daughter of the informant by Sunil Das with the help of his brother, Anil Das and his parents, Manager Das (petitioner no. 1) and Matisiya Devi (petitioner no. 2) and two others for the purpose of marriage.

Submission is that while the occurrence of kidnapping is said to be of 11.06.2017, but, the first information report is lodged after one week. In fact, dud to love affairs, daughter of

No.64171 of 2019(2) dt.22-10-2019 2/2 the informant left her house according to her sweat will with Sunil Das, son of the petitioners, and performed marriage about which she has also stated in her statement recorded under Section 164 of the Criminal Procedure Code. Petitioners, being the parents of co-accused, Sunil Das, have falsely been implicated in this case.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Gopalpur P.S. Case No. 91 of 2017 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge Icum-Special Judge (SC/ST/POCSO), West Champaran at Bettiah, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
