Petitioner seeks bail in Baunsi P.S. Case No. 21 of 2015 registered for the offence punishable under Section 302, 201/34 of the IPC.
Allegation against the petitioner in the F.I.R. is that he murdered his own wife who was married 15 years ago and threw the dead body in the Bari of one Mishraji. Mark of strangulation was also found on the throat of the deceased. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Informant is not the eye-witness. The allegation is general and omnibus in nature. Petitioner has got no criminal antecedent and
Patna High Court Cr.Misc. No.65694 of 2018 (3) dt.20-11-2018 2/2 is in custody since 10.03.2015.
Considering the nature of allegation, I am not inclined to grant bail to the petitioner at this stage, as such his application for bail is rejected.
Trial court is directed to conclude the trial within six months from today. If the trial is not concluded within the aforesaid period, the petitioner would be at liberty to renew his prayer for bail.
