The petitioners apprehend their arrest in connection with Purnea Sadar P.S. Case No. 480 of 2017 registered under Sections 147, 149, 341, 323, 384, 379 and 506 of the Indian Penal Code. The accusation is that at about 3 P.M., on 01.09.2017, informant, Ajit Sarkar, was at his grocery shop situated at Gulabbagh Mandi Purnea. At that time, petitioners along with 8 to 10 unknown came there and started to abuse and demanded ransom of Rs.2,00,000/-. At that time, petitioner no. 1, Ajit Bhagat pointed the
Patna High Court CR. MISC. No.64512 of 2019(2) dt.04-11-2019 2/2 pistol at his temporal then due to fear, informant fled away and reached at the shop of Rajesh Gupta. Thereafter, they also reached there and caused assault to him at the shop of Rajesh Gupta. At that time, they snatched gold chain from his neck. Learned counsel for the petitioners submits that, in fact, petitioners and the informant were running the shop jointly, but later on, petitioners separated their shop due to that reason, informant lodged the present case with false allegation. Further submission is that petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, in connection with Purnea Sadar P.S. Case No. 480 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
