2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 120B of the IPC and sections 25(1-B)(a), 26 and 35 of the Arms Act.
3. On secret information, Police conducted raid and apprehended two accused persons with one loaded country made pistol, mobile phone and a motorcycle, while petitioner managed to escape from the place.
4. Learned counsel appearing for the petitioner submits that petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused who is his villager and inimical to him. No incriminating material has been recovered from the conscious possession of the petitioner and he has falsely been implicated in this case on suspicion. Petitioner claims clean antecedent.
5. Considering the facts of the case, this pre-arrest bail petition is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Begusarai or the
Patna High Court CR. MISC. No.73126 of 2023(2) dt.09-11-2023 2/2 successor Court in Matihani Police Station Case No. 51 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
