The petitioner seeks bail in a case initially registered under Section 379 of the Indian Penal Code but later on, charge sheet was submitted under Sections 379 & 411 of the Indian Penal Code.

Allegedly, the stolen motorcycle of the informant, was recovered from possession of the petitioner.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 29-06-2019. Charge sheet has already been submitted. The petitioner has been made accused in the present case on the basis of self-confessional statement. The petitioner had no knowledge that the motorcycle

Patna High Court CR. MISC. No.64229 of 2019(2) dt.17-10-2019 2/2 in question is a stolen property. The petitioner has been made accused in the present case due to mistake of fact. On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Motihari, East Champaran in connection with Paharpur P.S. Case No. 183 of 2019.
