The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,354B,504 and 506 of the IPC.

The prosecution case as per the written report of Geeta Devi submitted to the SHO, Supaul Mahila Police Station is to the effect that on 19.4.2018 when the informant went to ease out, then the petitioner caught hold of her and outraged her modesty.

It is submitted by learned counsel for the petitioner that the petitioner is the agnate of the informant. In fact, when the petitioner made protest for easing out in his agricultural field, the accusation has been levelled. It is further submitted that the impugned order suggests that the witnesses have not supported the prosecution case. Statement has been made in paragraph 3 of

Patna High Court Cr.Misc. No.65182 of 2018(2) dt.13-12-2018 2/2 the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the petitioner is named in the FIR Considering the nature of accusation and the fact that during investigation several witnesses have not supported the prosecution case, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Supaul in connection with Supaul Mahila P.S. Case No.50 of 2018 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
