2. The petitioner seeks bail in connection with Udwant Nagar (Gajraiganj) P.S.Case No. 438 of 2023 registered for the offence punishable under Sections 323, 341, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The informant, who is himself a veteran criminal has lodged this FIR.

4. It has been submitted by the learned counsel for the petitioner that the occurrence had taken place because the prosecution side had tried to grab the land of the petitioner and in the said occurrence both the sides have sustained injuries.

5. It has also been submitted that the petitioner is in custody since 09.04.2024 and has got one criminal antecedent.

6. Ms. Priya, learned counsel for the informant vehemently opposed the prayer for bail.

7. Considering the period of custody of the petitioner, this application is allowed.

8. Let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in Udwant Nagar (Gajrajganj) P.S.Case No. 438 of 2023.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Udwant Nagar Police Station 1st and 3rd Sunday of every month. Any default in appearance at the Police Station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
