JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 The petitioner seeks regular bail in connection with Madhepura P.S. Case No. 763 of 2018 (Excise Case No. 1157/18), registered for offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 125 liters liquor from the possession of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case. It has also been submitted that though he is accused in one more case of similar type, but he is on bail in that case. Further submission is that the vehicle is not used by the petitioner and he is in judicial custody since 17.09.2018.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Patna High Court Cr.Misc. No.67086 of 2018(2) dt.26-11-2018 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge (Excise Act) Madhepura, in connection with Madhepura P.S. Case No. 763 of 2018 (Excise Case No. 1157/18), subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
