The petitioner has prayed for bail in a case registered for the offence punishable under sections 25(1-b) a/26 of the Arms Act.

Prosecution case relates to recovery of one country made loaded pistol, a live cartridge and one mobile phone from possession of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. His name transpired in this case on the basis of confessional statement of apprehended accused person before the police, which has no evidentiary value in the eye of law. The entire recovery is planted one. Due to his long criminal antecedents, local police

Patna High Court CR. MISC. No.69514 of 2022(2) dt.28-02-2023 2/2 used to implicate him in one case after another cases. Petitioner is languishing in judicial custody since 7.8.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 577 of 2022.
