The petitioner seeks bail in Bihta P. S. Case No. 725 of 2018 instituted for the offence under Section(s) 420, 286/34 of the Indian Penal Code and Sections 4 and 5 of the Explosive Substance Act, 1908 and Section 63 of the Copy Right Act. Learned counsel for the petitioner has submitted that petitioner was arrested on the spot with injured condition. In the written report, it is alleged that informant got information that crackers are being prepared in the house where explosion has taken place. The petitioner was also found in the house along with other injured. It is further alleged that several manufacturing articles of crackers and explosive

Learned counsel for the petitioner submits that petitioner was merely sitting in the house. He has no concern with the manufacturing article of the aforesaid crackers. It has further been submitted that other co -accused with similar allegation has already been granted regular bail by co-ordinate Bench of this Court by order dated 26.10.2018 passed in Cr. Misc. no. 63218 of 2018.

Petitioner is in custody since 5.7.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM 1 Danapur in connection with Bihta P. S. Case No. 725 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
