JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-02-2023 Heard the learned counsel for the petitioner and the learned APP for the State. The petitioner seeks regular bail in connection with Sultanganj P.S. Case No.333 of 2022, registered for the offences punishable under Sections 20 and 22 of the NDPS Act & Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

The allegation is regarding recovery of 6 bottles of Dialex cough syrup and 6 strips of Nitrazepam tablets from the petitioner.

The learned counsel for the petitioner has submitted that the petitioner is innocent, he

Patna High Court CR. MISC. No.70670 of 2022(2) dt.09-02-2023 2/3 has been falsely implicated in the present case, he is having a clean antecedent and he is languishing in custody since 14.09.2022. The learned counsel for the petitioner has further submitted that the petitioner is an old person aged about 70 years and is suffering from various ailments, and moreover, he has been falsely implicated in the present case on account of animosity of the informant with him.

Per contra, the learned APP for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the minor quantity of the narcotics substance contained in the said cough syrup, apart from the fact that the petitioner is having a clean antecedent, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail

No.70670 of 2022(2) dt.09-02-2023 3/3 bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judgecum-Special Judge, Drugs and Cosmetics Act, Bhagalpur in connection with Sultanganj P.S. Case No.333 of 2022.
