The petitioner has filed the instant application for grant of bail in connection with Kauwakol (Rupo) P.S. Case No. 16 of 2019 (District-Nawada) registered for the offence punishable under sections 384 and 34 of the Indian Penal Code. As per the allegation in the FIR, two persons with their face covered came by a motorcycle to the shop of the petitioner and handed over a paper in which 'rangdari' had been demanded.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown and the name of the petitioner has transpired in course of confession of coaccused before the police. He has not been put on T.I. Parade

Patna High Court CR. MISC. No.73106 of 2019(3) dt.18-12-2019 2/2 and is in custody since 12.7.2019. Chargesheet has been submitted in the case. It is further submitted that co-accused Makeshwar Pandey has been enlarged on bail by order dated 20.11.2019 passed in Cr.Misc. No.68901 of 2019 while other co-accused Md. Rijwan Shah has been enlarged on bail by order dated 5.12.2019 passed in Cr.Misc. No.78156 of 2019. The application for bail was opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including grant of bail to the similarly situated co-accused, the petitioner not being put on T.I. Parade and being in custody since 12.7.2019, the Court is inclined to enlarge the petitioner on bail. Let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Nawada in connection with Kauwakol (Rupo) P.S. Case No. 16 of 2019 (District-Nawada).
