====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-06-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.
Petitioner apprehends his arrest in connection with Darbhanga P. S. Case No.139 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 120B, 324, 307, 448, 504, 379, 354, 435, 436, 506, 411 of the I.P.C. Petitioner is named in the first information report and there is specific allegation that he gave order to other accused to commit loot in the house of informant and set the house of informant on fire.
Learned counsel appearing for the petitioner submits that several co-accused have already been granted privilege of
Patna High Court CR. MISC. No.66179 of 2019(6) dt.17-06-2020 2/2 anticipatory bail by different Benches of this Court and, moreover, no specific overt act has been attributed against this petitioner.
Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, his prayer for anticipatory bail stands rejected.
However, it is made clear that this order shall not cause any prejudice to the concerned Court at the time of consideration of regular bail application of the petitioner. (Hemant Kumar Srivastava, J) vikash/- U T
