Petitioner, who is in custody, seeks bail in connection with Muffasil P.S. Case No. 285 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is of recovery of total 55.575 liters of English wine from the Sumo Vehicle which was driven by the petitioner.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Petitioner is driver and has no knowledge about the illegal wine. Petitioner has no concern either with seized liquor or the Sumo Gold vehicle. Nothing has been recovered from the

Patna High Court Cr.Misc. No.67284 of 2018(2) dt.26-11-2018 2/2 conscious possession of the petitioner. Petitioner has no criminal antecedent and is in custody since 20.08.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Muffasil P.S. Case No. 285 of 2018.
