Petitioner is apprehending arrest in connection with Karpi PS Case No. 83 of 2018 for the offence under Sections 341, 323, 39, 354, 447 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the petitioner and the informant are agnates and there is going property dispute between them. There is no specific overt act alleged against the petitioner.
Considering that the petitioner has no criminal antecedent, this application is allowed. Accordingly, in the event of arrest or surrender before the court below within a period of one month from today, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten
Patna High Court Cr.Misc. No.66822 of 2018(2) dt.17-12-2018 2/2 thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate II, Arwal in connection with Karpi PS Case No. 83 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
