JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This is an application for grant of anticipatory bail in connection with Belaganj P.S. Case No.279 of 2019, disclosing offences under Sections 30(a) and 37(c) of the Bihar Prohibition and Excise Act.

As per F.I.R. police got an information about the sale of liquor by the petitioner, raided the place and there is recovery of 02 liters of illicit liquor from there and it is said that petitioner succeeded in fleeing away from the spot. Submission of the learned counsel for the petitioner is that recovery is not from the house of the petitioner or at his instance, rather same has been recovered beside the Temple and he has falsely been implicated in this case, having no criminal antecedent.

Having heard both sides, in view of the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender and pray for regular bail before the learned court below, the same shall be considered on its own merit, without being prejudiced by order of this Court, and if, possible, to be disposed of on the same day.
