Petitioner apprehends his arrest in connection with Nautan P.S. Case No.89 of 2019, for the offence punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a), 38(i), 41(i) of the Bihar Prohibition & Excise Act, 2016.

The allegation against the petitioner is that police upon secret information intercepted the motorcycle and recovered a total quantity of 16.740 and 27.800 litres of illicit liquor from the motorcycle and also arrested co-accused Pappu Kumar Pandey and Satan Yadav. The name of the petitioner has been disclosed by arrested co-accused persons. Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.65467 of 2019(2) dt.07-11-2019 2/2 that the petitioner has not committed any offence and his name has been dragged in this case on the basis of statement made by the arrested co-accused persons. Learned counsel further submits that motorcycles which were seized by the police do not belong to the petitioner.

After having heard learned counsel for the petitioner as well as learned counsel appearing on behalf of the State and taking into consideration the fact that petitioner have got criminal antecedent and two cases of similar nature are pending against him, I am not inclined to grant to anticipatory bail to the petitioner and the same is hereby rejected.
