JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Naubatpur P.S. Case No. 389 of 2018 for the offence under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against this petitioner is that he has fired on the waist of the informant.

Learned counsel for the petitioner submits that the petitioner and the informant are in inimical terms and way back in 1992 the petitioner has filed complaint case against the father and mother of the informant. In 2010 also, the father of the petitioner has filed Information Petition No. 374 of 2010 dated 30.03.2010. In 2014, the uncle of the petitioner has filed complaint case against the informant and his family members under Sections 147, 148, 149, 341, 323, 326, 307, 504, 452,

Patna High Court CR. MISC. No.67272 of 2019(4) dt.06-02-2020 2/2 337, 384, 380 of the Indian Penal Code and Section 27 of the Arms Act.

Referring to the aforesaid, learned counsel for the petitioner submits that the petitioner has been made only on account of dispute between the parties. He further submits that the petitioner has got no criminal antecedent and he is in custody since 09.07.2019.

Considering the fact that the petitioner has got no criminal antecedent and the parties are in strange relationship, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur, Patna in connection with Naubatpur P.S.
