The petitioners are languishing in custody in a case registered for the offences punishable under Sections 341, 323, 307, 302/34 of the Indian Penal Code.

It is alleged that all the F.I.R named accused persons including the petitioners assaulted the son of the informant, as a result of which, he sustained injuries and subsequently succumbed to the injuries.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.84514 of 2023(2) dt.10-01-2024 2/3 petitioners that petitioners are innocent and they have falsely been implicated in this case. There is general and omnibus allegation against the petitioners and in the background of some previous dispute, the present accusation has been levelled against the petitioners. The petitioners are languishing in custody since 05.08.2023. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Moreover, similarly situated co-accused has been granted the privilege of bail by a coordinate Bench of this Court vide order dated 06.01.2023 passed in Cr. Misc. No. 11819 of 2022.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like
