JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 The petitioners seek regular bail in connection with Amanour P.S. Case No. 190 of 2016, registered for offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code.

Allegation as per F.I.R. is that while the father of the informant was fishing in a ditch, a dispute arose between father of informant and co-accused Shivnath Rai, on which, petitioners and others assaulted father of informant causing serious injuries to him and he succumbed to those injuries. It has been submitted on behalf of the petitioners that only general and omnibus allegation has been attributed to the petitioner and no specific allegation has been levelled and though it is alleged that petitioners assaulted the deceased

Patna High Court Cr.Misc. No.65515 of 2018(2) dt.22-11-2018 2/2 with Talwar but no injury caused by Talwar has been found on the dead body of the deceased.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Saran at Chapra, in connection with Amanour P.S. Case No. 190 of 2016, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
