Petitioners seek bail in Kajra P.S. Case No. 04/2017, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

Allegation is of committing murder of informant's son. It has been submitted that petitioners have falsely been implicated in this case. F.I.R. is against unknown. There is no eyewitness of the occurrence. Similarly placed co-accused have been granted bail by different benches of this court vide order dated 29.08.2018 passed in Cr. Misc. No. 43546/2018 and order dated 10.10.2018 passed in Cr. Misc. No. 62229/2018. Petitioners have no criminal antecedent. They are in

Patna High Court Cr.Misc. No.65677 of 2018 (2) dt.06-11-2018 2/2 custody since 13.07.2018.

Considering the facts aforesaid, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Kajra P.S. Case No. 04/2017, subject to the conditions:

(1.) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2.) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court.

(3.) If the petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
