Petitioner seeks bail in Excise Case No.355 of 2018 instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.
It is alleged that total 225 litres Nepali Saufi liquor has been recovered from the sack allegedly carried by the petitioner.
Counsel for the petitioner submits that petitioner has no criminal antecedents. It is further submitted that it is a case of mistaken identity. In fact, the person, who was involved, has managed to run away.
Petitioner is in custody since 04.08.2018.
Patna High Court Cr.Misc. No.68694 of 2018(2) dt.29-11-2018 2/2 In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, East Champaran at Motihari, in connection with Excise Case No.355 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
