JUSTICE JITENDRA KUMAR ORAL ORDER 22-12-2023 The present petition has been filed for modification of the order dated 30.08.2023 passed by this Court in Cr. Misc. No. 56649 of 2023, whereby the petitioner has been granted anticipatory bail.

2. As per the statement of the Pairvikar, there was no criminal antecedent against the petitioner. However, learned counsel for the petitioner submits that Pairvikar is a villager and hardly literate and hence he could not properly brief the counsel regarding the criminal antecedent of the petitioner. Therefore, learned counsel for the petitioner could not mention that the petitioner has criminal antecedent at the time of filing the anticipatory bail, whereas, the petitioner has one criminal antecedent bearing Jaynagar P.S. Case No. 124 of 2023 under

Patna High Court CR. MISC. No.84159 of 2023(2) dt.22-12-2023 2/2 Section 448, 341, 323, 380, 377, 504 & 506 of the I.P.C.

3. In view of the aforesaid facts and circumstances of the case, the impugned order 30.08.2023 is modified to the extent that petitioner has one criminal antecedent as stated above.

4. Accordingly, the present modification application stands allowed.

5. This order would be integral part of the impugned order dated 30.08.2023 passed in Cr. Misc. No. 56649 of 2023. (Jitendra Kumar, J) shoaib/- U T
