The petitioner seeks regular bail in connection with Gopalpur P.S. Case No. 12 of 2016, instituted for the offences punishable under Sections 147, 148, 149, 323, 341, 307, 504, 302 of the Indian Penal Code.
Allegation against this petitioner and seven other F.I.R. accused persons is that they brutally assaulted the father of the informant who in course of treatment died.
Learned counsel for the petitioner submitted that from the written report, it appears that specific allegation of assault is against Lal Babu who assaulted the deceased by brick as a result he lost his consciousness. The other co-accused persons namely, Vijay Rai and Pradeep Rai having allegation of assault to the deceased have been allowed bail vide order dated 17.10.2016
Patna High Court Cr.Misc. No.5553 of 2017 (2) dt.07-02-2017 2/2 passed in Cr. Misc. No. 44717 of 2016. The case of this petitioner stands on similar footing of the co-accused. In autopsy report, the doctor has not mentioned about any external injury on the person of the deceased. The petitioner is in custody since 17.12.2016 having no criminal antecedent.
Having regard to the facts and circumstances of the case, the prayer for bail made on behalf of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Patna in Gopalpur P.S. Case No. 12 of 2016.
