JUSTICE SANJAY PRIYA ORAL ORDER 04-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Sarsi P.S. Case No. 16 of 2016 instituted for the offence under Section(s) 364, 498A, 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

It has been submitted that there is general and omnibus allegation against this petitioner who is husband of the daughter of the informant. It has further been submitted that earlier the daughter of the informant has fled away with the husband of her sister for which father of this petitioner has filed Complaint Case No. 268 of 2016 and thereafter the instant case has been filed levelling allegation that this petitioner and other accused persons

Patna High Court Cr.Misc. No.8751 of 2017 (3) dt.04-04-2017 2/2 had got the daughter of the informant disappeared. Later on, the daughter of the informant appeared before the learned Magistrate and gave her statement under Section 164 Cr.P.C vide Annexure4, wherein she has levelled general allegation against this petitioner and other accused persons.

The petitioner is said to be in custody since 21.10.2016.

In such circumstances, keeping in view the aforesaid background of this case and the behaviour of the daughter of the informant, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Purnea in connection with Sarsi P.S. Case No. 16 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
