2. The petitioner apprehends his arrest in a case registered for the offences punishable under sections 341, 323, 308, 325, 504, 34 of the Indian Penal Code.
3. As per prosecution case, all the three FIR named accused persons including the petitioner and some unknown accused persons abused and assaulted the informant with lathi, danda and hockey sticks due to which he sustained several injuries.
4. It is submitted on behalf of the petitioner that this petitioner is innocent and has falsely been implicated in this case. Allegation of assault is general and omnibus and no specific overt act has been alleged against this petitioner. Seized motorcycle does not belong to the petitioner. Co-accused, with similar allegation, has already been allowed pre-arrest bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No.73447/2023. Petitioner claim clean antecedent.
5. Learned counsel for the State opposes the prayer for pre-arrest bail.
6. Considering the aforesaid facts of the case, prayer for bail of this petitioner is allowed. In the event of
Patna High Court CR. MISC. No.68798 of 2025(2) dt.07-10-2025 2/2 arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VIII, Patna in Parsa Bazar Police Station Case No. 174 of 2021, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
