JUSTICE ALOK KUMAR PANDEY ORAL ORDER 17-10-2025 This application has been filed for modification of the order dated 28.05.2025 passed in Cr. Misc. No. 35168 of 2025 seeking extension of time for furnishing bail bonds of the petitioner.
2. Learned counsel for the petitioner submit that petitioner has already been granted privilege of anticipatory bail vide order dated 28.05.2025 passed in Cr. Misc. No. 35168 of 2025. Learned counsel further submits that due to death of uncle of the petitioner's counsel, information has not been given to the petitioner with regard to grant of anticipatory bail on 28.05.2025. He further submits that on 10.09.2025, the petitioner inquired about his case, then it came to notice that
Patna High Court CR. MISC. No.72536 of 2025(2) dt.17-10-2025 2/3 information with regard to grant of anticipatory bail has not been given to the petitioner. He further submits that time for furnishing bail bonds has expired on 08.07.2025. Learned counsel further submits that due to said reason, the petitioner failed to furnish bail bonds within the stipulated period of time and now, learned counsel prays that the time for furnishing bail bonds may be extended by another four weeks from today.
3. Learned Additional Public Prosecutor appearing for the State has no objection over the same.
4. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the time for furnishing bail bonds by the petitioner is extended by another four weeks from today, on same terms and conditions as stipulated in order dated 28.05.2025 passed in Cr. Misc. No. 35168 of 2025, in connection with Shakurabad P.S. Case No. 248 of 2024 to the satisfaction of learned Special Judge, Excise1, Jehanabad.
5. Accordingly, order dated 28.05.2025 passed in Cr. Misc. No. 35168 of 2025 is modified to the extent stated above.
6. The present modification application, accordingly, stands allowed.
