Mr. Sri Murlidhar ====================================================== CORAM: HONOURABLE MR JUSTICE MADHURESH PRASAD ORAL ORDER 13-12-2018 Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner apprehends arrest in Kishanganj Mahila Police Station Case No 37 of 2018 registered under Sections 354A, 506 of Indian Penal Code and Section 8 of Prevention of Children from Sexual Offences Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Relying upon the petitions (Annexure 3 series), it is submitted that the matter has been compromised and the informant does not support the allegations made in the first information report. Considering the nature of allegations and the fact that the victim has supported the same in her statement under

Patna High Court Cr.Misc. No.65612 of 2018(2) dt.13-12-2018 2/2 Section 164 of Criminal Procedure Code as also the fact that the victim is only 16 years of age, prayer of petitioner for anticipatory bail is rejected.

However, the petitioner's prayer for regular bail may be considered on its own merit without being prejudiced by the rejection of his prayer for anticipatory bail by this Court. (Madhuresh Prasad, J) M.E.H./- U
