The petitioner seeks bail in a case registered under Sections 307, 393 & 400 of the Indian Penal Code. The prosecution case in short is that the petitioner along with his associates was caught by the people while he was attempting to snatch motorcycle. One Gupti is said to have been recovered from possession of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 12-06-2019. Charge sheet has already been submitted. The petitioner has been made accused in the present case due to mistake of fact. The
Patna High Court CR. MISC. No.64023 of 2019(2) dt.17-10-2019 2/2 allegation of snatching the motorcycle is denied by the petitioner. The other co-accused with similar allegation has been granted bail by a coordinate bench of this court vide order dated 27-09-2019 passed in Cr. Misc. No. 61506 of 2019. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 703 of 2019.
