This application, for grant of anticipatory bail, arises out of Complaint Case No. 75 of 2018 for the offences punishable under Sections 323, 379, 498A and 504/34 of the Indian Penal Code.
A report was sought for from the Mediator who has informed this Court that parties have resolved the matrimonial dispute in terms of settlement which is agreed between them and the terms of agreement mutually signed by the petitioner and his wife, Opposite Party No.2 on 16.03.2023, the Court below is
Patna High Court CR. MISC. No.68091 of 2019(8) dt.20-03-2023 2/2 directed to release the petitioner on provisional bail subject to the condition that petitioner must appear before the Court below within one week from the date of this order and the Court below shall release the petitioner on provisional bail for a period of one year and in the meantime, if either of the parties breach any of the terms and conditions of mutual agreement dated 16.03.2023, this order will automatically loose it force. The provisional bail granted to the petitioner shall be confirmed as per the conditions laid down under Section 438 (2) of the Code of Criminal Procedure, if the O.P. No.2 does not make any complaint against the petitioner.
